1. Introduction and Acceptance

1.1. These Terms and Conditions ("Terms") govern the supply and installation of plantation shutters, blinds, and related products ("Products") by ShutterLuxe ("we", "us", "our") to you ("the Customer" or "you").

1.2. By accepting a quotation, placing an order, or using our website, you agree to be bound by these Terms.

1.3. We are a family-run business based in Yorkshire, operating under the name ShutterLuxe.

2. Quotations and Orders

2.1. Quotations: All quotations are provided free of charge following a home consultation. Quotations are valid for [State Specific Time Period, e.g., 30 days] from the date of issue.

2.2. Product Changes: Any changes requested to the Product specifications, style, or material after the order is placed may be subject to additional charges and a delay in the delivery timeframe.

3. Price and Payment

3.1. Pricing: The price of the Products and installation will be as set out in the accepted quotation. All prices include VAT unless otherwise stated.

4. Cancellation and Variations

Right to Cancel: Because all Products are custom-made to your specific requirements, once the initial deposit is paid and the manufacturing process has begun (typically within 48 hours), you **do not** have a right to cancel the order under The Consumer Contracts Regulations 2013, unless the Products are faulty or not as described.

4.2. Cancellation Before Manufacture: If you cancel before manufacturing has commenced, we will refund any amount paid less the non-refundable deposit to cover administrative and design costs.

5. Delivery and Installation

5.1. Lead Times: Estimated lead times are given in good faith but are estimates only. We are not responsible for delays caused by external factors (e.g., shipping, manufacturing delays) beyond our reasonable control.

5.2. Preparation: You must ensure the area around the windows is clear of furniture, decorations, and obstructions before the installation date. Our installers will take reasonable care of your property but are not responsible for moving heavy items.

5.3. Installation Damage: We will exercise reasonable care during installation. We are not responsible for minor imperfections in plaster or paintwork that may occur during the fitting process, nor are we responsible for any structural deficiencies in your window frames.

5.4. Acceptance of Works: You must inspect the installed Products upon completion. Signing the final invoice confirms your acceptance that the Products are installed correctly and to a satisfactory standard.

6. Product Guarantees and Defects

6.1. Quality Guarantee: We guarantee that the Products will correspond with the agreed specifications and be free from material defects at the time of installation.

6.2. Warranty: The specific warranty period for each product (e.g., Antigua Shutters, Blinds) will be detailed on your quotation. This warranty covers manufacturing defects and installation issues.

6.3. Exclusions: The warranty does not cover: fair wear and tear; damage caused by misuse, negligence, or improper cleaning; colour fading due to excessive sun exposure; or damage caused by alterations made by the Customer or third parties.

7. Limitation of Liability

7.1. Our total liability to you for any breach of contract or negligence arising in connection with the supply and installation of Products shall not exceed the total price paid by you for the Products and services.

7.2. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

8. Website Use

8.1. All content on our website (including text, images, and logos) is the property of ShutterLuxe and is protected by copyright law.

8.2. Your use of our website is subject to these Terms and our Privacy Policy.

9. Governing Law

9.1. These Terms are governed by the law of **England and Wales** and are subject to the exclusive jurisdiction of the courts of England and Wales, as ShutterLuxe is a Yorkshire-based business.
